Terms of Service
Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Reflection Period: the period during which the consumer can exercise their right of withdrawal.

Consumer: a natural person who does not act in the course of a profession or business and enters into a distance contract with the entrepreneur.

Day: calendar day.

Ongoing Transaction: a distance contract relating to a series of products and/or services, for which the delivery and/or acceptance obligations are spread over time.

Durable Medium: any means that allows the consumer or entrepreneur to store information addressed personally to them in a way that allows future reference and unchanged reproduction.

Right of Withdrawal: the consumer’s right to cancel the distance contract within the reflection period.

Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.

Distance Contract: a contract concluded within a system organized by the entrepreneur for selling products and/or services at a distance, where only one or more means of distance communication are used up to and including the conclusion of the contract.

Means of Distance Communication: any means that can be used to conclude a contract without the consumer and the entrepreneur being physically present together.

Terms and Conditions: these Terms and Conditions of the entrepreneur.
Article 2 – Applicability
These terms and conditions apply to every offer made by the entrepreneur and every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed that the terms and conditions can be inspected at the entrepreneur and will be sent free of charge upon request.
If the distance contract is concluded electronically, the terms and conditions can be made available electronically so that the consumer can easily store them on a durable medium. If this is not reasonably possible, the consumer will be informed where the terms and conditions can be consulted electronically and that they will be sent free of charge upon request.
If specific product or service terms also apply, the above provisions apply accordingly. In case of conflicting terms, the provision most favorable to the consumer will prevail.
If any provision of these terms and conditions is null or void, the remaining provisions remain in effect. The null or void provision will be replaced by a provision that closely reflects the original intent.
Situations not covered by these terms should be interpreted in the spirit of these terms. Any ambiguities in the terms will also be interpreted in their spirit.
Article 3 – The Offer

Offers are without obligation unless otherwise stated.

The entrepreneur reserves the right to adjust or modify offers.

Offers include a full and accurate description of the products and/or services to allow the consumer to make an informed decision. Images are a true representation, but slight differences in color may occur.

All images, specifications, and details are indicative and cannot lead to compensation or cancellation of the contract.

Each offer provides clear information on: price (excluding customs and import VAT), shipping costs, contract formation, right of withdrawal, payment, delivery, duration, archiving, data verification, available languages, behavior codes, and minimum duration for ongoing transactions.

Optional: available sizes, colors, materials.
Article 4 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets any conditions.
If accepted electronically, the entrepreneur will immediately confirm receipt electronically. Until confirmation, the consumer may cancel the agreement.
The entrepreneur takes appropriate technical and organizational measures to secure electronic data and ensure a safe online environment. For electronic payments, suitable security measures will be in place.
The entrepreneur may check the consumer’s ability to pay and other factors to responsibly enter into the contract. If reasonable grounds exist, the entrepreneur may refuse or set special conditions for orders.
Upon delivery, the consumer will receive information about:

Requirements for canceling ongoing contracts longer than one year or indefinite duration
For ongoing transactions, the above applies to the first delivery only.
All contracts are subject to product availability.
Article 5 – Right of Withdrawal
Consumers may cancel a product purchase within 14 days without reason. The period starts the day after receipt of the product.
During this period, the product must be handled carefully and only used as necessary to determine if it will be kept. If returned, it must include all accessories, in original packaging where possible, following the entrepreneur’s instructions.
The consumer must notify the entrepreneur of withdrawal within 14 days after receipt. The product must then be returned within 14 days, with proof of shipment if requested.
Article 6 – Costs in Case of Withdrawal
Return shipping costs are the consumer’s responsibility. Paid amounts will be refunded within 14 days after receipt of the returned product or proof of shipment.
Article 7 – Exclusion of Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for certain products (e.g., personalized items, perishable goods, broken sealed audio/video/software, hygienic products) and certain services (e.g., accommodations, travel, events, betting), provided this is clearly stated in the offer.
Article 8 – Prices
Prices are fixed for the validity period stated in the offer, except for VAT changes or products with market-dependent prices. Errors or misprints do not obligate the entrepreneur to deliver at the incorrect price.
Delivery outside the EU may incur import VAT/customs, which the consumer is responsible for.

Article 10 – Conformity and Warranty
Products and services comply with the agreement, advertised specifications, reasonable quality standards, and applicable laws.
Manufacturer warranties do not affect statutory consumer rights. Complaints must be reported within 14 days. Warranty does not cover improper use, alterations, or government-mandated material specifications.
Article 11 – Delivery and Execution
Delivery occurs at the address provided by the consumer. Products are delivered within 30 days unless otherwise agreed.
If delivery is impossible, a replacement will be offered. Risk of damage or loss remains with the entrepreneur until delivery to the consumer or their representative.
Article 12 – Ongoing Transactions
Termination: Consumers may terminate ongoing contracts with notice periods up to one month.
Extension: Contracts for a set period cannot be silently renewed except for short-term subscriptions (max 3 months), which the consumer may terminate with notice.
Duration: For contracts longer than one year, the consumer may terminate after one year with one month’s notice, unless fairness prevents early termination.
Article 13 – Payment
Amounts owed must be paid within 7 days after the reflection period starts. Consumers must immediately report incorrect payment details. Late payments may incur reasonable fees.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days of noticing an issue. Complaints are answered within 14 days or acknowledged with an estimated response time. Valid complaints will be resolved through repair or replacement.
Article 15 – Disputes
Dutch law applies to all agreements covered by these terms, even if the consumer resides abroad.
Article 16 – CESOP
From 2024 onwards, payment service providers may register certain data in the European CESOP system to comply with VAT regulations and payment reporting requirements.
